Condition of Sale.

All property is sold "as is", neither the auctioneer nor consignor make any warranties or representations of any kind or nature written or verbal with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty, of description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property and no statement made at the sale, or in the bill of sale, or invoice or elsewhere shall be deemed such warranty or representation or an assumption or liability. |

The highest bidder as determined by the auctioneer shall be the purchaser. Any bid which is not commensurate with a fair value of the article offered or which is merely a nominal bid or fractional advance may be rejected by the auctioneer if in his judgment such bid would be likely to affect the sale injuriously. Items may be withdrawn at any time prior to the offering of each lot. If in the case of a disputed bid, the auctioneer shall have sole discretion in determining the purchaser, and the galleries record shall be conclusive in all respects. |

The purchaser assumes complete responsibility for items at the fall of the gavel. All merchandise purchased must be paid for and removed from the premises the day of the auction, unless other arrangements have been authorized with the auction house. Shipping is arranged as a courtesy and at the buyer's expense. Any items not collected within 30 days after the date of sale will subject to a storage charge of $50.00 per month. |

Out of State checks will be acceptable only if credit has been established with Kenneth W. Van Blarcom, or a bank authorization has been received guaranteeing a personal check. We reserve the right to hold merchandise purchased by personal check until the check has cleared the bank; if such action is deemed necessary to protect our interests. |

Absentee bidding will be executed when possible as a convenience to our customers. The auction house will not be held responsible for any errors or failure to accurately execute bids. Bidders must submit absentee bids prior to auction, either in writing or verbaly over the telephone, |

All purchases are subject to the Massachusetts five (5) per cent sales tax unless the purchaser possesses a Massachusetts sales tax exemption number. |
